New Appraisal Rule for Foreign Real Estate Buyers - Hürriyet

Turkey has introduced a new regulation that directly affects real estate sales involving foreign nationals. Starting from March 4, 2019, a property appraisal report became mandatory for all property transactions where a foreign citizen takes part as a buyer or seller. This step aims to increase transparency and support fair pricing across the housing market.

Appraisal Report Now Mandatory for Foreign Property Sales

The regulation was announced through a circular published by the General Directorate of Land Registry and Cadastre (TKGM). According to the circular, every sale involving foreign nationals must include an appraisal report that shows the market value of the property. The rule applies to all property types and all regions of Turkey. Authorities expect this system to prevent excessive pricing and reduce unregistered activity in the construction sector.

Bayram Tekçe, Chairman of the Board of Antalya Homes, evaluated the new regulation and explained that the foreign property sales market was selected as a pilot area within the Ministry of Environment and Urbanization’s 100-day action plan. This plan includes the launch of the Real Estate Appraisal System. Tekçe stated that the regulation is important for Turkey’s brand value and said the system would protect foreign buyers from inflated prices and fraudulent practices.

The property appraisal requirement had already been applied to real estate purchases linked to citizenship applications. With the new regulation, this obligation now covers all property sales involving foreign buyers. Appraisal reports will remain valid for three months from the date they are issued. These reports can be used for any sale during this period. A new appraisal report will be required if a change occurs that affects the property’s value.

Special rules also apply to properties under construction. In these cases, the appraisal will be calculated based on the projected value after completion. The declared sale price cannot be lower than the value stated in the appraisal report. A higher declared price can still be recorded as reported. All appraisal reports will continue to be prepared by experts licensed by the Capital Markets Board (SPK).

Tekçe also recalled that the Real Estate Appraisal Department was established within TKGM in early February. He stated that appraisal reports are expected to become mandatory for all property sales across Turkey starting in 2022. Before nationwide implementation, the foreign sales market was chosen due to its lower transaction volume.
